Snow removal services apply to snow fall accumulations of 5cm or more
We will accommodate time requests where possible, however delays due to weather, traffic, equipment problems and other factors beyond our control may occur, and we are not liable in any way for such delays.
Note: Timing of town or city snow plows is beyond our control. If the town plows leave snow at the end of your driveway after we have completed our final pass, and you would like us to remove this snow, please call us to make arrangements. There will be an extra fee for this service.
The Client authorizes the installation of pickets by the Contractor. These pickets serve to outline the boundaries of the Clients driveway, as well as high-light areas of difficulty. Pickets will be removed and collected by the Contractor as soon as possible, following the end of the snow removal season. The Client should not remove the pickets since snowfall may occur in mid-April.
For clients that have selected optional shovelling services, the shovelling will be done by a separate crew member and this service is done on an as available basis. This means that every effort is made to complete the shovelling as soon as possible after the driveway is cleared, however, as this is a manual labour service provided in generally poor and unpredictable conditions, no time of completion can be suggested. Shovelling of residential sidewalks is considered a secondary priority service and we will prioritize clearing of driveways and commercial sidewalks. Clients can expect that residential sidewalks should be cleared within 24 hours following the driveway clearing, but generally they will be cleared the same day.
The Contractor is not responsible for any items or objects left on the driveway. The Client is responsible to remove basketball nets, or at least turn them away from facing the driveway.
It is the responsibility of the Client to make sure that if any water valve caps are protruding in their driveway, to contact the City or Town and have a technician come by and lower the pipe.
The Contractor is not responsible for any damages or inconveniences that may be caused by gravel driveways.
The customer is responsible for removing vehicles and any articles from the areas where snow is to be removed. Edgewood Construction is not liable for damage to landscaping, fencing, fixtures, or other elements hidden by snow accumulation or any damage from snow removal equipment coming into contact with pavement or other surfaces. Snow will be piled or blown onto areas such as lawns, which may cause damage to grass or plants. The homeowner understands that Edgewood Construction is not liable for any damage due to this operational requirement.
Edgewood Construction is not responsible for damage caused in any way by piled snow or run off, whether caused by blown or piled snow - whether or not snow is blown onto or near items of property - or drifting. Edgewood Construction is not responsible for any claim of damage made more than 48 hours after the last clearing.
Edgewood Construction’s equipment will only clear up to approximately 2 feet (further in wet snow conditions) of any garage door or wall and will only clear within approximately 2 feet of any parked car or other obstruction. The client is responsible for any snow accumulation that cannot be safely cleared by equipment.
Edgewood Construction is responsible to carry a minimum of $1,000,000 commercial liability insurance as well as WSIB coverage.
The contractor does not conduct spot checks and does not assume any liability for slips, falls, injuries of any kind, or damage to property due to slippery conditions.
Any amounts not paid under any contract option, will incur interest at the rate of 26.82% per annum (2% monthly) in addition to other costs incurred by the contractor, including but not limited to: All solicitor and client costs, lien charges, and any court or collection agency costs required to collect.
Fixed contracts:
This contract is for a fixed price for the winter, regardless of the amount of snowfall. No discount is given for minimal snowfall. This contract covers snow removal service when snowfall exceeds 2 inches at the discretion of the contractor, and generally a maximum of 1 clearing in a 24 hour period (normally in the morning). Extra call out fees will apply should the homeowner require additional clearings that do not fit within these parameters. Cases of heavy storms may warrant an additional clearing later in the day but sometimes that will delay the clearing the next morning. Cancellations of either contract option made by the client for whatever reason, do not absolve the client of payment in full of the contracted amount.
3 year renewal - additional terms:
The client is responsible for a complete 3 year term and may transfer this contract to new occupants or may transfer this contract to a new property within the area served by Edgewood Construction. In the event of a complete cancellation, only full seasons can be cancelled, and the homeowner shall be responsible for a penalty for early cancellation not to exceed 25% of the remaining contract. The contractor maintains the right to refuse renewal for any full season not started for any reason. In this case, no cancellation penalty would apply.
Terms effective: October 6, 2016
